As costs are regulated, notaries must comply with the regulations to avoid sanctions for unfair competition.

The fee charged by the Notary for his services must be adjusted to the regulations governing the NOTARIAL FEE (RD 1426/1989, of November 17, which regulates the Notary Fee). DOCUMENTED ACT

It is the fact, act or legal transaction reflected in the deed or writing, such as a sale, donation, will or inheritance. These are divided into two categories:

DOCUMENTS WITH QUANTITY:

These are those that have an economic value, such as the price of a sale, the value of a donation or the amount of a mortgage loan. They are known as ACTS OF QUANTITY, and if a deed documents several of these acts, each one constitutes a BASE that is priced according to an increasing scale.

When the value does not exceed €6,010.12:————————- €90.151815.
For the excess between €6,010.13 and €30,050.60: ——4.5 per 1,000.
For the excess between €30,050.61 and €60,101.21: —–1.50 per 1,000.
For the excess between €60,101.22 and €150,253.03: —1 per 1,000.
For the excess between €150,253.04 and €601,012.10: — 0.5 per 1,000.
For the excess from €601,012.11 up to €6,010,121.04: ——–0.3 per 1,000.

DOCUMENTS WITHOUT A QUANTITY:

These are those that cannot be valued economically because they do not imply an amount or valuable thing, such as a power of attorney, will, appointment of administrator or photographic record. They are called ACTS WITHOUT A QUANTITY and, for each one, a FIXED AMOUNT is applied.

Thus, the first minuted concept is obtained by adding the amounts corresponding to the acts of value or without value included in the deed.

For certain acts, such as home sales or mortgages, the Law establishes REDUCTIONS, which reduce the resulting amount. INCREASES can also be applied, such as procedures or departures from the office, which are charged separately.

DOCUMENT PAGES

The length of the deed affects its price, increasing with each additional page after the fifth, at a cost of €3.02 per extra page. However, the number of pages does not influence the price of an intervened bank policy.

COPIES ISSUED

Copies, whether simple or authorized, generate additional costs. The amount to be charged varies according to the number of pages in the copy and the years it has remained in the custody of the Notary.

Discounts at the Notary:

Notary competition in the prices of deeds is allowed through legal reductions in the cost, derived from the precise application of the Tariff.

VAT

Like any delivery of goods or provision of services in general, the Notary’s is subject to VAT at the general rate of 21%, which must be applied to the base formed by the sum of all the above concepts.
